Dear Barry Silbert, if you call the CrippleCoin as 'Bitcoin', you actually lied to NYDFS on NY hearings in 2014.

On NY hearings, you defended Bitcoin before NYDFS Governors. When being asked what's the benefit of Bitcoin, you explicitly said that low transaction fee was and would be one important benefit because of the removal of middleman.
If you support an artificially crippled coin today, it's your freedom. Yet if you support unnecessarily high fee by calling it as 'bitcoin' to cause user confusion, that means, you deliberately and intentionally lied to NYDFS on NY hearings in 2014.
It's a crime.

Anyone knows how to get Jesses Powell's attention? The 1 million dollar he donated to Coincenter just blew on his face. The NYS Version of the ULC Bitlicense is dead.

Coincenter has been pushing for the last 3 or 4 years the ULC Bitlicense which was modeled on the NYS Bitlicense with a few cosmetics carve-outs.

Today the ULC (Uniform Law Commission) asked the States to Withdraw their Model Act, aka the ULC Bitlicense. This after the Forbes articles came out.

This would not have been possible without the help of all the bitcoiners that showed up at every hearing in Nebraska and Hawaii. With the material provided by the Bitcoin Foundation, they were able to present compelling arguments against the ULC bitlicense. Each time they showed up, each time they won.

This time I suspect the bitcoiners in Wyoming to have done excellent work in working with their legislators. I have not being in active contact with them.

Bitcoin is about about grassroots.


For the past 5 years I have been trying to define Bitcoin in a way that allow the legislators to wrap their head around it and came up with those two definitions:

It's like the banana. Bitcoin is the banana and Blockchain is the tree on which the banana's grow. Blockchain and the Blockchain Token are virtual concept.

They are not perfect but would allow to start a meaningful discussion with the legislator. The Asset, the Money, the Security, etc is what you transform the Intangible Commodity into when you use it.

My trial is coming up this Thursday (March 28, 2019) and I would love to talk to u/jespow about which fight to put his money toward and help the whole community. I have not communicated with him but if someone know how to get hold of him, please let him know I would like to talk.

So I may not be able to provide final or definitive answers to all of the questions you ask. But I’ll do my best to try and provide a window into some of our thinking at this stage. For those of you interested in some background on our agency’s work in this area, NYDFS has been conducting an inquiry on the appropriate regulatory guidelines for virtual currency firms for the last seven months. As part of that inquiry, in January 2014, NYDFS held public hearings in New York City on virtual currency. More than 14,000 people from 117 countries tuned into those hearings online, which was not the usual turnout we get!

Our expectation is that – during the course of 2014 – the information we’ve gathered in our fact-finding effort will allow us to put forward a proposed regulatory framework for virtual currency firms operating in New York. We want to move expeditiously because the sooner we provide some regulatory certainty, the better for the firms that want to know what the rules of the road are. At the same time, we recognize this is complicated stuff and we don’t want to go too fast, make a mistake, and create unintended consequences. Hello,
The BitLicense was instituted in September 2015 in the State of New York and it is been used as a model regulation around the world. (Europe might be interested in doing something similar.)
Since October 2015, I have been fighting the Bitlicense in the courts in New York City. In October 2017, my case finally heard in front of a judge. (You can read the transcript here.)

She is wrong and we are appealing the decision. We are looking for people interested to file Amicus Briefs to the appellate court. The whole process is documented by my lawyer in this document. (The deadline is November 1st, 2018)

The ULC Bitlicense copy of the NYS Bitlicense is dead. Does anyone know how to get Jesses Powell's attention? He donated 1 million dollars to Coincenter and the bill they were pushing died and I would like to talk to him.

Coincenter has been pushing for the last 3 or 4 years the ULC Bitlicense which was modeled on the NYS Bitlicense with a few cosmetics carve-outs.
Today the ULC (Uniform Law Commission) asked the States to Withdraw their Model Act, aka the ULC Bitlicense. This after the Forbes articles came out.

This would not have been possible without the help of all the bitcoiners that showed up at every hearing in Nebraska and Hawaii. With the material provided by the Bitcoin Foundation, they were able to present compelling arguments against the ULC bitlicense. Each time they showed up, each time they won.
This time I suspect the bitcoiners in Wyoming to have done excellent work in working with their legislators. I have not being in active contact with them.

Bitcoin is about about grassroots.

For the past 5 years I have been trying to define Bitcoin in a way that allow the legislators to wrap their head around it and came up with those two definitions:
It's like the banana. Bitcoin is the banana and Blockchain is the tree on which the banana's grow. Blockchain and the Blockchain Token are virtual concept.
They are not perfect but would allow to start a meaningful discussion with the legislator. The Asset, the Money, the Security, etc is what you transform the Intangible Commodity into when you use it.
My trial is coming up this Thursday (March 28, 2019) and I would love to talk to u/jespow about which fight to put his money toward and help the whole community. I have not communicated with him but if someone know how to get hold of him, please let him know I would like to talk.

I am for Cities banning mining from the electric grid.

Hear me out on this one before going all crazy on my statement.
I started working on bitcoin in 2013, at the time I turned political after they started banning it in New York State. (You can read the whole story here: https://article78againstNYDFS.com don't know my work in the space.)

The goal of bitcoin is to create a network that doesn't rely on the physical properties of the current world. Banking system (to convert BTC to Fiat or the Electric Grid to mine.
When I became politically involved I was working to get an ASIC chip powered by a 3W DIY by Solar panel. The idea at the time is that mining should come from renewable energy and that we the bitcoiners would be able to save the world.
Because of politicians like Chuck Schumer that doesn't get it, they managed to screw it up for everyone. We were supposed to get our electricity from renewable energy.
We need to go back to that research ! If every community were to forbid mining from the electric grid and force renewable energy, we could protect the network (the difficulty rate would plummet back down to very low) but BitMain would be pissed because it would take a while before they could make money.
My business Chino Ltd, before he started a lawsuit against NYDFS in New York, did not have a bank account and did not do business using the Banking System.

Quick update on the my Lawsuit against the Bitlicense in New York State.

The Attorney General of the State of New York filed his motion to dismiss friday night.
The new document is the Memorandum of Law in Support of the Motion to Dismiss and there attacking my standing.
It's a bit funny because they are saying that for me to attack them I would have to do something illegal and actually risk going to jail. They claimed I submitted an incomplete application and therefore I was not subject to the Bitlicense. However, I started the lawsuit before they answered said application. I never closed my business; I am still in business but can't do any processing because I am waiting for the court to determine whether the Bitlicense is a legal thing or not.
Now Pierre Cirric is preparing our response; last time he wrote: "Courts have relaxed their standing analyses in light of the increasingly pervasive role that administrative agencies play in impacting the daily lives of citizens."
Once again we'll ask for the Limited Discovery and this time it's going to be interesting.
The 1st of December 2016, U.S. Magistrate Judge Hugh B. Scott from the Western District of New York wrote a report that explain that Bitcoin is not money (unfortunately, it's not a binding decision because the case judge never got to decide on the report but it's still significant because it was researched and written by a legal scholar.) Over the course of the last two years, people have started to write that bitcoin is not money.
This case has the ability to change thing; but until then the fight continues and you help
